Central Alabama Water (hereinafter referred to collectively as “Central Alabama Water” or “CAW”) is strongly committed to protecting the privacy of you, its customers, and the users of this web site. In light of this commitment, CAW adheres to the practices provided below.
CAW does not disclose or sell any personal information about you without your prior approval, except as required by law and as requested by regulatory agencies and governmental authorities. CAW uses the information collected on this web site only to better provide you with CAW’s services. From time to time, CAW may change its privacy policy and will make reasonable efforts to publish such changes. Furthermore, CAW adheres to strict security procedures to protect your information more fully.
Collecting and using personal information
When you submit personal information to CAW, you are agreeing to permit CAW to access, store, and use the information wherever in the world CAW does business, both inside and outside the United States. In particular, CAW may use your personal information for various business purposes, such as statistical analyses, generating surveys, doing market research, improving its services, and notifying you about services and changes that may affect you, among other business purposes all in an effort to better serve and provide you with the best service available.
In some cases, CAW’s web site links to other sites that collect personal information by and for other parties. In these cases, the personal information you provide on those sites is governed by the privacy policy of that site. CAW does not assume responsibility for the actions of other parties. However, CAW will use reasonable efforts to maintain secure connections with you and limit access to databases containing your personal information to authorized parties, including our own employees, whose access to your information is on a need-to-know basis. As such, our employees are trained to protect your privacy.
Controlling Central Alabama Water’s use of personal information
CAW’s web site is primarily intended for adults and not children under 18. CAW will not knowingly collect personal information from children without the consent of a child’s parent or guardian and will not knowingly use or disclose personal information collected from children for any purpose.
“Cookie” use
“Cookies” are small text files that are stored on your computer’s hard drive by a web site through your browser. “Cookies” enable a website such as CAW’s website to keep track of your activities on that web site, and to improve your use of the site, such as by keeping track of your preferences. “Cookies” do not include any personal information. Additionally, you can change your browser settings on your personal computer, so that “cookies” are not stored on your hard drive.
Disclosure to government
CAW reserves the right to monitor and disclose, without your consent, any communications or personal information, whenever requested to do so by courts, government agencies or by law enforcement authorities.
CAW will use reasonable efforts to address concerns you may have about your personal information. You may contact CAW by using the “Contact Us” area of the site.
MOBILE COMMUNICATIONS
- Scope; Definitions. This section of the CAW public water system website privacy policy (this “Policy”) governs how CAW uses text messages (including SMS and MMS) and mobile phone calls (including prerecorded/artificial voice calls, where applicable) to communicate with customers and other individuals who provide a mobile telephone number to CAW (collectively, “Mobile Communications”). For purposes of this Policy: (a) “Customer” means an individual or business account holder for water service with CAW; (b) “Consent” means the level of permission required under applicable law for the specific Mobile Communication, including the Telephone Consumer Protection Act, 47 U.S.C. § 227, and implementing regulations and guidance (the “TCPA”); (c) “Service Messages” means non-marketing communications related to water service, billing, account administration, operational updates, and public health and safety; (d) Emergency Messages” means communications made for emergency purposes, including urgent notices regarding water quality, boil water advisories, contamination events, pressure loss, service interruptions, and other time-sensitive public safety matters; and (e) “Marketing Messages” means messages that encourage the purchase of goods or services or otherwise constitute telemarketing under applicable law.
- Permitted Uses; Compliance with Law. CAW may use Mobile Communications to deliver Service Messages and Emergency Messages and, only where permitted by law and with any required Consent, Marketing Messages. CAW will conduct Mobile Communications in compliance with applicable federal and Alabama laws and regulations, including the TCPA and any Alabama requirements applicable to public water systems’ customer and public notifications. CAW does not sell Customer mobile numbers for third-party marketing.
- Consent and Customer Choices.
- How Consent May Be Provided. Where Consent is required, Customers may provide Consent by submitting a mobile number through CAW’s website, customer portal, paper or electronic service application, customer service interaction, or other method that reasonably evidences permission to receive the applicable category of Mobile Communications at that number. Consent, if provided, is limited to the purposes described at the time the number was provided and as further described in this Policy.
- No Condition of Service. Unless expressly permitted by applicable law, CAW will not condition the provision of water service on a Customer’s Consent to receive Marketing Messages.
- Opt-Out; Revocation of Consent. Customers may opt out of non-emergency text messages at any time by following the opt-out instructions provided in the message (for example, replying “Stop,” where supported) or by contacting CAW using the contact methods posted on CAW’s website. Opt-out requests will be implemented within a commercially reasonable time. Opting out of non-emergency messages may limit CAW’s ability to provide certain convenience features (such as appointment reminders) but will not prevent CAW from sending Emergency Messages or other messages that may be permitted without opt-in Consent under applicable law.
- Help and Support. Customers may request help regarding Mobile Communications by using the contact methods posted on CAW’s website. Message and data rates may apply depending on the Customer’s mobile plan.
- Message Content, Frequency, and Identification. CAW will use reasonable efforts to ensure Mobile Communications are (a) limited to the stated purpose, (b) clear and not misleading, and (c) appropriately identify CAW as the sender or caller. Message frequency will vary based on account activity, service conditions, and emergencies. CAW will not intentionally send Marketing Messages outside any hours restricted by applicable law.
- Data Collected and Used for Mobile Communications. In connection with Mobile Communications, CAW may collect and use: (a) mobile telephone number; (b) Customer name and service address; (c) account identifiers; (d) communication preferences and Consent status; (e) message delivery status and logs; and (f) any information a Customer provides in response to a message or call. CAW uses this information to authenticate the Customer, deliver Mobile Communications, maintain records of Consent and opt-out requests, investigate and resolve service issues, support security incident investigations, and comply with legal obligations.
- Information Security; Access Controls; Retention. CAW will maintain administrative, technical, and physical safeguards designed to protect information used for Mobile Communications against unauthorized access, alteration, disclosure, or destruction. Such safeguards may include, as appropriate: (a) documented procedures for granting and terminating access to systems used to send Mobile Communications; (b) unique user accounts for personnel and contractors with role-based access; (c) multi-factor authentication for remote access and, where feasible, for cloud-based systems supporting Mobile Communications; (d) monitoring of system access and use; (e) maintenance logs to support security incident investigations and to protect logs from unauthorized modification or deletion; (f) malware detection and timely security patching for systems used to manage Customer contact information; (g) controls for mobile equipment used by authorized personnel (including mobile phones and laptops) to reduce the risk of unauthorized access; (h) backup and disaster recovery procedures for critical communication systems; and (i) secure disposal procedures for equipment and media containing Customer contact information. CAW will retain Mobile Communication records (including Consent and opt-out records) for the period required by applicable law or, if no specific period applies, for as long as reasonably necessary to demonstrate compliance, resolve disputes, and meet operational needs, after which CAW will securely dispose of such records.
- Service Providers; Restricted Use; Transfers. CAW may use third-party service providers to facilitate Mobile Communications (for example, messaging platforms, call service providers, or customer relationship systems). CAW will require such service providers, by contract, to: (a) use Customer information only to provide services to CAW and not for the service provider’s own marketing; (b) implement reasonable security measures consistent with this Policy; (c) restrict access to authorized personnel; (d) notify CAW of security incidents affecting Customer information used for Mobile Communications; and (e) return or securely dispose of Customer information at the end of the engagement, subject to legal retention requirements. CAW will not knowingly transfer Customer mobile numbers outside the United States for Mobile Communications processing unless appropriate safeguards are in place and such transfer is permitted by applicable law.
- Accuracy of Contact Information; Customer Responsibility. Customers are responsible for providing and maintaining a current mobile number and for notifying CAW if the number changes. Customers represent that they are authorized to provide the mobile number submitted to CAW and to receive Mobile Communications at that number. If a Customer reassigns or disconnects a number, the Customer should promptly update their account information to reduce the risk of messages being sent to a reassigned number.
- Emergency and Public Safety Communications. CAW may send Emergency Messages by text or mobile phone call when CAW reasonably believes an emergency exists or when urgent public safety communications are required or appropriate. Emergency Messages may be sent even if a Customer has opted out of non-emergency messages, to the extent permitted by applicable law. CAW will use reasonable efforts to limit Emergency Messages to information necessary to address the emergency and to provide timely instructions and updates.
- Governing Law; Venue. This Policy and any dispute arising out of or relating to Mobile Communications will be governed by the laws of the State of Alabama, without regard to conflict-of-laws principles, and applicable federal law. To the extent not preempted by federal law, venue for any action relating to this Policy will lie in a court of competent jurisdiction located in Alabama.
